Copyright & DMCA Policy

FounderGem LLC respects intellectual-property rights and expects ClipGem users to do the same. This policy explains how to report content you believe infringes your copyright and how we respond, consistent with the U.S. Digital Millennium Copyright Act (DMCA).

1. Reporting infringement

If you own a copyright (or are authorized to act for the owner) and believe content made or stored through the Service infringes it, send a written notice to our Copyright Agent that includes all of the following:

  1. Your physical or electronic signature (your typed full legal name is fine).
  2. Identification of the copyrighted work you claim was infringed (or a representative list, if multiple).
  3. Identification of the material you claim is infringing and enough information for us to locate it (for example, a URL or a description of where it appears in the Service).
  4. Your name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief the use isn't authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in your notice is accurate and that you're the owner or authorized to act on the owner's behalf.

Please use “DMCA Notice” as the subject line so we can route it quickly.

3. What we do with a valid notice

When we receive a complete, good-faith notice, we will act expeditiously to remove or disable access to the material in question and will make a reasonable effort to notify the user who provided it.

4. Counter-notice

If your content was removed and you believe it was a mistake or misidentification, you may send a counter-notice to our Copyright Agent containing:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the location where it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for the district of your address (or, if outside the U.S., any district in which we may be found), and that you'll accept service of process from the party who filed the original notice.

If we receive a valid counter-notice, we may restore the material in 10 to 14 business days unless the original complainant notifies us they've filed a court action to stop the alleged infringement.

5. Repeat infringers

Consistent with the DMCA, we will, in appropriate circumstances, terminate the accounts of users who are repeat infringers.

6. Misrepresentation

Under the DMCA, knowingly making a material misrepresentation in a notice or counter-notice can expose you to liability for damages. Make sure your claim is accurate before you submit it.
